There are different fence laws in almost every state to protect livestock, people, and property from damage that livestock can cause inside their property line. There are two kinds of laws: open range and closed range. States choose one of two patterns, though some states let counties choose their own.
In an open range area, animals are free to roam, and neighbors build fences to keep them out of their yards or property lines. As a general fence law, a person who doesn’t put up a fence can’t blame a neighbor whose animals hurt their property if they don’t have a fence.

A landowner can keep his animals from wandering away by having a fence built that meets state or local building codes. If the farmer’s fence was constructed following proper standards, the property owner could file a lawsuit against the cattle owner if, for instance, the neighbor’s cows breach the fence and damage the crops.

State laws often spell out what makes boundary fences “legal.” The rules can get very specific, requiring certain types of wire, heights, and even the placement of the posts.

Cities are not in the business of sending out fence inspection teams, so a nonconforming fence can stay up for as long as there are no complaints.Let your neighbor know about the law as soon as you can. The property owners probably don’t know the law, and if the fence is still being constructed, they might be able to modify it affordably. Your legal duty is to inform the authorities if they advise you to keep your affairs to yourself. Most of the time, all that is needed is a phone call to the city attorney’s office, the planning or zoning department, or both. If the neighbors don’t follow the order, the city may fine them or even take legal action against them
Unless the property owners agree otherwise, such fence structures along a property line belong to both owners when both are using the fence. The fence is the joint responsibility of the two owners, and neither may have it removed without the consent of the other.

Some states have harsh penalties for refusing to contribute to maintenance after the other owner makes a reasonable request. A landowner naturally doesn’t need to sue very often. Talking with your neighbor about the issue should be your first action. The fact that you are taking the initiative to fix a fence that is already an eyesore and could eventually turn into a real hazard will likely please your neighbor.
